What's the story with the RUDN student who was expelled for posting on instagram? Parental control over student progress.

The gold on red “Graduate” with a year that has not yet passed is hidden behind the cabinet door, the endless collection of documents, the excitement for the results of the Unified State Examination and entrance exams are almost forgotten, and instead of the indistinctly beautiful “applicant”, his own child now proudly calls himself a “student” with the addition of weighty abbreviations. And now you are not left with thoughts in the spirit of "Oh, how quickly children grow up ...". Have you grown up? Yes, quite, and ripe for a huge to-do list, the study of which is somewhere between arguing with older generations and proving someone wrong on the Internet. Are they adults? Not at all. With the receipt of a student card of any university, neither experience, nor knowledge, nor a sense of responsibility for one's decisions and actions come. Everything will be, but much later.

While a young man who keeps a student's card in his pocket, and in his head - memories of schoolchildren and hopes for student freedom, gets used to a new way of life

Parents only dream of peace. Controlling the progress of an overage child is not only a natural, but also a necessary phenomenon, and the educational measures used to increase interest in the process of acquiring knowledge have practically no limits - up to the traditional parental belt or blocking access to social networks.

The intention to follow the successes and failures of the student is one thing, but the implementation of it is quite another. The teachers do not call the mother to the dean's office, do not require the signature of the parents in the record book with failures, do not collect teachers' councils. And if a young talent is in no hurry to report on his achievements (and more often about their absence), then happy ignorance may soon turn into a message about expulsion, sometimes accompanied by an invitation to the draft board. And here, information technologies come to the aid of parents worried about the fate of the child. Most Russian universities create special progress control pages on their websites, where you can find out the results of the session passed by him, get acquainted with the existing academic debts by the number of student or record books, passport or other data confirming the identity of the student.

Some higher educational institutions introduce a rating system for students, and already by the state of the rating one can judge the attendance and academic performance of a person who is drawn to knowledge. Sometimes points are added to the rating, and each teacher evaluates the progress of a young person in his course. It is traditionally believed that the ten-point system optimally meets the requirements of both university staff and students' parents. Not only academic achievements can be evaluated, but also activity, participation in socio-cultural events, scientific projects.

In addition to the point-rating system and the publication of information from the test and examination sheets, on the progress control pages you can find a form of communication with the dean's office - it makes it possible to ask a question, if not to the teacher, then to the secretariat employee, who will share the information of interest to parents. However, Russian universities do not have a centralized system, like school "electronic diaries", and each alma mater decides the issue in accordance with its capabilities. In some universities, as before, the child's progress will be told only at a personal meeting with the curator or representative of the dean's office.

The institution of curatorship, recognized several years ago in a number of educational institutions as a senseless waste of labor resources and time, is now being revived. Teachers and psychologists say that it is extremely difficult for young people to adapt to the conditions of the university after ten years of sitting at school desks. Curators, to whose role teachers are appointed, are called upon to help adapt within the walls of the university, as well as fulfill the duty of an educator and mentor. Monitoring the progress, attendance and behavior of students is also the responsibility of the curator, as well as communication with parents. In addition, responsible teachers monitor the living conditions of students living in dormitories, help those in need with financial assistance, and act as intermediaries in communication between students and university management.

Although the study of most of our students does not take place “in the French side, on an alien planet”, parents experience excitement no less than the notorious student who is serving for knowledge. And in order to feel completely calm and let your student know that you are aware of his successes, you should arm yourself with information about the numbers of the record book, student ID, know the name of the faculty and the group number, get the address of the university’s website and do not be shy to ask. Adult solidarity against childish irresponsibility: they will give you all the pranks, mistakes and debts without a twinge of conscience and with a sense of accomplishment.

Organizationally, the work of a tutor in SAUUS is fixed by an approved Regulation(see link).

Let's look at the versions that can be formulated based on the answers and comments:

1. Nikita had academic debts and was expelled solely because of their non-liquidation

In accordance with Part 3 of Article 58 of the Federal Law of December 29, 2012 No. 273-FZ "On Education in the Russian Federation" (hereinafter referred to as the Federal Law), unsatisfactory results of intermediate certification in one or more academic subjects, courses, disciplines (modules) of the educational program or failure to pass the intermediate certification in the absence of good reasons are recognized as academic debt. By virtue of part 5 of the same article, students with academic debts have the right to pass an intermediate certification in the relevant academic subject, course, discipline (module) no more than twice within the time limits determined by the organization carrying out educational activities, within one year from the moment of formation of the academic debt. This period does not include the student's illness, academic leave or maternity leave. According to part 6 of the same article, a commission is created by an educational organization to conduct intermediate certification for the second time. In accordance with part 11 of the same article, students in basic professional educational programs, not liquidated in a timely manner academic debt, are expelled from this organization as not fulfilling their obligations for the conscientious development of the educational program and the implementation of the curriculum.

Thus, the hero of this question could be expelled due to the failure of one or more tests / exams only within the framework of the established procedure, which includes the obligation of the educational organization to organize at least two retakes, and for the second a commission is created (again, within the framework of special procedures ). Failure to comply with the requirements of the Federal Law may be appealed to the court.

2. Nikita spoke unethically about his university and thereby committed a disciplinary offense

A. Law does not regulate(from the word "absolutely") questions of morality and ethics. As for the protection of such intangible benefits as honor, dignity and business reputation, paragraph 1 of Article 152 of the Civil Code of the Russian Federation establishes that such protection is carried out only in judicial okay. Justice in the Russian Federation is carried out only by the court, except that the court is, you see, not a corporate high school cabal, which "knows better" whom to punish and pardon; a court is a specialized state body operating within the framework of norms, including civil procedural law (currently they are enshrined in the Civil Procedure Code of the Russian Federation). To put it simply: there is a plaintiff (PFUR), there is a defendant (Nikita); the plaintiff is obliged to prove that in relation to him it was the defendant who committed actions aimed at belittling his honor and dignity, undermining his business reputation; the defendant is obliged to prove that his actions (if these actions, of course, were committed by him) are not aimed at such derogation. The last word belongs to the court, which should not be bound by the positions of the parties.

B. Charter of the educational organization can not(from the word "absolutely") establish requirements for the sacredness of students. Even if the commandment "Honor your RUDN University and your Russia, may you be blessed and may you live long at the university" be fixed in such a charter, then it cannot be applied by virtue of Article 30 of the Federal Law: part 1 of the said article establishes that an educational organization accepts local regulations containing norms governing educational relations (hereinafter referred to as local regulations), within its competence in accordance with the legislation of the Russian Federation in the manner prescribed by its charter, and in accordance with part 4 of the same article of the norms of local regulations, worsening the situation of students or employees of an educational organization compared to the established legislation on education, labor law position or taken in violation of the established procedure, do not apply and are subject to cancellation by the educational organization.

C. On the issue of disciplinary sanctions: again, the measures of such penalties are applied within the framework of special procedures (parts 4-12 of Article 43 of the Federal Law). Whether these procedures were followed in relation to Nikita (if any) is a rather debatable issue, but not for TheQuestion. More for the court, most likely.

Findings:

  • If Nikita does not want to study at RUDN, does not want to get the profession he has fallen into, but wants to shoot video blogs and raffle - this is his personal choice; no need to disturb him.
  • If a student of RUDN University, Moscow State University, MGIMO etc. I don’t like my university because of harsh statements - this is a pure civil law dispute that cannot affect educational relations as such ( non bis in idem, if you want to).

    STUDENT PERFORMANCE MONITORING

    IIA RUDN University

    The RUDN Academic Council decided to introduce a point-rating system for monitoring students' knowledge in the educational process. Various versions of this system are being developed and put into operation in all divisions of the University. The problems of this new and rather complex methodological work were discussed at a university-wide seminar, which was attended by representatives of almost all departments of RUDN University.

    The rating system is based on the scores "earned" by the student during the semester. For one discipline (or section of the discipline, if its study ends with an exam), a student can receive more than 120 points in total. Most of the points he receives during the semester, a smaller part - for the exam. The system includes all types of student workload (theoretical material, practice, test, abstract, course work, etc.). The milestone control of progress (as a result of which the next number of points is scored) is carried out periodically after the completion of the study of a certain topic, etc. (for example, once a week or a month), but not less than four times for each discipline. The control is carried out within the terms established by the calendar plan. The control rules are brought to the attention of each student at the very beginning of classes in this discipline. When using a specific version of the system to assess students' knowledge, the features of the discipline and its educational and pedagogical principles are taken into account. Assessment of knowledge in state exams is carried out without the use of a point-rating system.

    The PFUR Academic Council approved three general options for the scoring system.

    Option 1. SYSTEM "P" (focused on disciplines with a large practical component)

    Based on the results of work in the semester, a student can receive an automatic grade - 5, 4 or 3 and may not take the exam. If the grade does not satisfy him (4 or 3), he has the right to take the exam and possibly increase his grade.

    A student who does not receive an automatic grade is required to take the exam. But if he did not score the minimum number of points during the semester (35), then he does not receive credit and is not allowed to take the exam.

    - the minimum number of points per semester is 35;

    optional exam for students who have automatic grades 5, 4, 3 during the semester.

    Option 2. SYSTEM "PT" (focused on disciplines with comparable practical and theoretical parts)

    According to the number of points in the semester, a student can automatically receive only 5 (by scoring the maximum number of points 91 - this is less than 100, but as an exception it gives “excellent”) or 4 (on the exam, you can improve the grade to 5, but already scoring at least 100 in total and at least 28 points for the exam itself). The rest of the students are required to take the exam. The one who did not score the minimum number of points (30) in the semester does not receive credit and is not allowed to take the exam.

    Option 3. SYSTEM "T" (focused mainly on theoretical disciplines)

    The student does not receive an automatic semester grade, but "earns" part of the grade. Everyone is required to take the exam. Those who did not score the minimum number of points (21) during the semester are not allowed to take the exam.

    - the maximum number of points during the semester is 80;

    - the maximum number of points for the exam - 40;

    - the minimum number of points per semester is 21;

    FOR CERTAIN TYPES OF WORK

    The teacher sets the maximum number of points based on the results of certain types of educational work independently, focusing on the total average number of points in the subject (120 points per semester):

    • for a particularly high quality of work, the mark can be increased by up to 50% of the maximum;
    • for violation of the deadlines for the provision of work, the assessment is reduced by 5% per day of delay;
    • violation of the rules for preparing abstracts, reports, abstracts is penalized with a minus point (within the marks for these types of work) - 15% of the maximum grade for one violation of the rules for preparing abstracts, reports, abstracts is set by the teacher in accordance with the requirements of the State Educational Standard;
    • unpreparedness for a seminar or practical lesson is assessed as a negative assessment from 1 to 5 points;
    • the teacher keeps a record of points separately for each student, the accumulated number of points is taken into account during the intermediate certification;
    • at the last seminar session, abstracts and other types and forms of written work are not accepted, except for those scheduled for this time.
