After considering the issue, we came to the following conclusion:

If an employment relationship has actually arisen with a student, that is, he is entrusted with the performance of all labor duties for the position provided for by the staffing table (profession, specialty), then it is necessary to conclude with him. If the student is only studying during the internship, then the organization is not obliged to conclude an employment contract with him.

Rationale for the conclusion:

At present, the organization of student practice is regulated by the Federal Law of December 29, 2012 N 273-FZ "On Education in the Russian Federation" (hereinafter referred to as the Law on Education), the Regulation on the Procedure for Conducting Practice for Students of Educational Institutions of Higher Professional Education, approved by order of the Ministry of Education of the Russian Federation dated 03/25/2003 N 1154 (hereinafter - Regulation N 1154), Regulation on the practice of students mastering the basic professional educational programs of secondary vocational education, approved by order of the Ministry of Education and Science of the Russian Federation of 04/18/2013 N 291 (hereinafter - Regulation N 291).

Work practice is an integral part of the main professional educational programs of higher and secondary vocational education, implemented in accordance with the federal state educational standards of higher and secondary vocational education (clause 24, article 2, clause 6, article 13 of the Law on Education, clause 1 of the Regulation N 1154, paragraph 1 of Regulation N 291). Work practice, as a rule, is carried out in organizations on the basis of agreements concluded between an educational organization and organizations operating under an educational program of the corresponding profile (clause 7, article 13 of the Law on Education, clause 8 of Regulation N 1154, clause 11 of Regulation N 291). Under such an agreement, students are sent to the organization for practice.

It should be noted that the legislation does not contain the norms that an employment contract must be concluded with interns at the place of internship, and therefore, it allows for the possibility of the absence of labor relations between the student-intern and the organization. This conclusion, in our opinion, is indirectly confirmed by the second part of Art. 227 of the Labor Code of the Russian Federation, which does not classify students and students of educational institutions of all types undergoing work practice as employees performing their duties under an employment contract. In addition, such a conclusion also follows from the literal interpretation of clause 10 of Regulation N 1154 and clause 11 of Regulation N 291, which provide that if there are vacancies, students can be enrolled in them if the work meets the requirements of the practice program.

Thus, the law does not provide for the need (obligation) to conclude an employment contract only by virtue of a student undergoing an industrial (educational) practice at an enterprise. Therefore, the need to conclude an employment contract with an intern will depend on whether an actual labor relationship arises between the organization and the student, or whether the student is only studying during the internship.

In accordance with Art. 15 of the Labor Code of the Russian Federation, labor relations are relations based on an agreement between an employee and an employer on the personal performance by an employee of a labor function (work according to the position in accordance with the staff list, profession, specialty, indicating qualifications; a specific type of work assigned to the employee), subordination of the employee to the rules internal labor regulations when the employer ensures the working conditions provided for by labor legislation and other regulatory legal acts containing labor law norms, a collective agreement, agreements, local regulations, an employment contract.

In other words, if during the internship a student is entrusted with his consent to perform a labor function (performing work in any position, profession, specialty; a specific type of work assigned), the student undertakes to obey the rules of the internal labor schedule, then such relations, by virtue of Art. 15 of the Labor Code of the Russian Federation, must be qualified as labor and executed in accordance with the requirements of the current legislation: by concluding an employment contract (Art. 56, Art. 57, Art. 67 of the Labor Code of the Russian Federation) * (1), issuing an order for employment (Art. 68 of the Labor Code of the Russian Federation), making an entry in the work book on employment (Article 66 of the Labor Code of the Russian Federation). If the employment contract is not executed in writing, it will still be considered concluded if the student employee starts work with the knowledge or on behalf of the employer or his representative (part two of article 67 of the Labor Code of the Russian Federation).

If, in the process of industrial practice, labor relations with the student do not arise, he only studies, acquires the necessary skills, skills, experience of practical work in the specialty (profession), then an employment contract is not concluded.

The organization of work practice at all stages is aimed at ensuring the continuity and consistency of mastering the skills of professional activity by students in accordance with the requirements for the level of training of a graduate in the specialty 030501 "Jurisprudence".

Places of practical training for students of civil law specialization, as a rule, are institutions that correspond to the profile of specialization. These include: courts of general jurisdiction; arbitration courts; legal departments of ministries, departments, organizations, enterprises, credit institutions, research organizations, etc.; specialized departments: patent office, consumer protection departments, etc.; legal (legal, contractual departments) of authorities and local self-government; notaries; advocacy, etc.

The student has the right, at his choice, to divide the practice in court into two parts and go through it, for example, two weeks in a court of general jurisdiction, and the second half - in an arbitration court (or other body), which will make it possible to understand the specifics of both civil and arbitration proceedings.

Regardless of the place of internship, the student must be familiar with the structure of the organization, its constituent documents, as well as with the contractual activities of the enterprise where he is doing internship: to get a general idea of ​​the contractual activity of a civil law nature, to get opportunities for practical development of issues related to with the conclusion of such contracts as, for example, a contract of sale (supply), a lease (sublease) contract, contracts for the provision of services; have an idea about the forms and methods of protection of violated civil rights, including the judicial form of protection.

The process of organizing industrial practice includes the following steps:

  • 1. Holding an organizational meeting of students in order to familiarize them with: the goals and objectives of the upcoming practice; with the timing of its implementation; with the requirements that apply to practice as a type of educational activity; with a list of internship bases offered by the university.

At this stage, students submit an application either indicating the internship base with which the university has an agreement to organize students' internship, or indicating the place of internship of their choice. In the latter case, the student, in addition to the application, submits a letter of guarantee. At the same time, the department has the right to refuse to agree on the place of internship if it considers that the goals and objectives of the internship will not be achieved. Students who do not submit an application are provided with practice bases by the department.
  • 3. Preparation of an order for an internship.
