REGULATIONS FOR TRANSPORTATION OF CHILDREN BY ROAD TRANSPORT
General provisions 1. These Methodological Recommendations determine the procedure for organizing and carrying out transportation of children, the main duties and responsibilities of officials and bus drivers who organize and transport children to and from vacation spots on a one-time order or a tourist-excursion route. These recommendations have been developed for all legal entities and individuals involved in the transportation of organized children's groups.2. The main objectives of these Guidelines are: - generalization of the requirements for ensuring the safety of transportation of organized groups of children in one document; - prevention of adverse effects on the body of children of harmful factors and conditions associated with staying in stationary conditions in passenger service areas and along the road; creation of a document that is used in the development of standards and work instructions by legal entities and individuals involved in the organization and implementation of the transportation of children's groups.3. These Guidelines apply when transporting groups of eight or more children by bus.4. The following terms and definitions are used in these Guidelines: Customer - an organization, legal entity or individual that is a consumer of a transport service for the transportation of children; Contractor - an organization, legal entity or individual that performs a service for the transportation of children at the request of the Customer. The functions of the Customer and the Contractor may be performed by one organization or legal entity that has both the need and the ability to provide services.5. In accordance with the Law of the Russian Federation of 07.02.92 N 2300-1 "On Protection of Consumer Rights", the Customer of the transport service has the right to receive information from the Contractor on the quality and completeness of the preparation of vehicles and drivers for the transportation of children.6. Mass transportation of children by car column (3 buses or more) is carried out only if the Customer has a notification from the traffic police about the allocation of a special escort car to the car column. The notification of the traffic police is presented by the Customer together with the application for the transportation of children by car column to the Contractor.7. Basic requirements for the organization of transportation of children 1. To organize the transportation of children, the Customer must conclude an agreement with the Contractor. At the same time, the Contractor is obliged to have a license for this type of activity and a license card for the operated vehicle, unless the specified activity is carried out to meet its own needs. Transfer of a license or license card to another carrier is prohibited.2. If an economic entity, including a children's institution, has its own (own) bus (buses), then the requirements of all regulatory documents related to ensuring the safety of transportation also apply to it. In the absence of such opportunities, the bus must be based and serviced by the Contractor, who is able to ensure that all necessary requirements for ensuring the safety of transportation are met.3. Drivers who have a continuous three-year or more experience in motor vehicles of category "D" and who have not violated the current Rules of the Road for the past three years are allowed to transport groups of children.4. Transportation of organized groups of children is carried out with mandatory escort for the entire period of the trip for each vehicle of an adult accompanying person, and if the number of children transported is more than twenty - two accompanying persons. Before the trip, accompanying persons undergo a special briefing together with the driver, conducted by the authorized representative of the Contractor or, as an exception, by the head of the Customer on the basis of these Guidelines. The Customer is responsible for the safety of transportation of children in the part that concerns him.5. An automobile convoy with children to their destination is accompanied by an ambulance. If the number of buses is less than three, it is necessary to have a qualified medical worker in each bus.6. The technical condition of the Contractor's buses must meet the requirements of the basic provisions for the admission of vehicles to operation. The driver must have a valid ticket on passing the state technical inspection of the bus.7. The bus must be equipped with: - two easily removable fire extinguishers with a capacity of at least two liters each (one - in the driver's cab, the other - in the passenger compartment of the bus); - yellow square identification marks with a red border (square side - at least 250 mm, width borders - 1/10 of the side of the square), with a black image of the road sign symbol 1. 21 "Children", which must be installed in front and behind the bus; - two first aid kits (car); - two wheel chocks; - an emergency stop sign; - when traveling in a column - an information plate indicating the place of the bus in the column, which is installed on the windshield of the bus on the right in the direction of travel; - buses with more than 20 seats, manufactured after 01.01.98 and used on tourist trips, must be equipped with tachographs - control devices for continuous recording of the distance traveled and speed, driver work and rest time. In this case, the owner of the vehicle is obliged to comply with the requirements of the Rules for the use of tachographs in road transport in the Russian Federation, approved by Order of the Ministry of Transport of Russia dated 07.07.98 N 86.8. The class of the bus must correspond to the type of transportation of children carried out. Before leaving the line, each bus must undergo an inspection of the technical condition and compliance of equipment with the requirements established by the Rules of the Road.9. When leaving the line to the place of landing, the driver must personally check the condition of the equipment of the bus.10. A car column with children is accompanied by a special traffic police car moving ahead of the column. If the number of buses in the convoy is more than 10 units, the traffic police additionally allocates a car that closes the convoy. When transporting groups of children by one or two buses, escort by a special traffic police car is not necessary. Accompanying a convoy of buses when transporting groups of children by car is carried out from the place of formation to the final destination .eleven. In case of mass transportation of children, the head of the Contractor shall appoint: - from among the drivers allowed to transport children - the senior driver; - from among the specialists of the Contractor's employees - the senior car column. The senior driver, as a rule, drives the last bus of the column.12. Before the transportation of organized children's groups, the Contractor, together with the Customer, no later than 10 days before the scheduled start date of the transportation, submits to the relevant departments of the traffic police an official notice of the planned transportation indicating: - the date and route of the movement; including the determination of the time of passing the checkpoints of the route, places of stops and rest, equipped in accordance with the requirements of sanitary legislation; - schemes of the route of movement and maneuvering with the designation of dangerous sections, traffic police posts, medical aid points, hospitals, etc. ;- confirmation of the allocation of medical support;- brand and state number of the bus (buses), names of drivers who will transport children, with lists of children and persons accompanying them, approved by the territorial departments of education.13. The customer is obliged to provide organized groups of children who are on the road for more than three hours with sets of food products (dry rations) with the coordination of their assortment with the territorial departments of Rospotrebnadzor in the constituent entities of the Russian Federation in the prescribed manner, and also provide for compliance with the drinking regime during the movement in accordance with the current sanitary legislation.14. After the first three hours of continuous driving, the bus driver must provide the driver with a special break to rest from driving on the road for at least 15 minutes. In the future, breaks of such duration are provided for no more than every two hours. In the event that the time of granting a special break coincides with the time of granting a break for rest and meals, no special break shall be granted. When sending two drivers on one bus, they change at least every three hours.15. Before the start of mass transportation of children to health camps, a special commission is appointed by order of the head of the Contractor, which conducts a preliminary survey of access roads to health camps and, based on the condition of the roads, determines the possibility of transporting children to health camps and special recreation areas, about which an appropriate act is drawn up .sixteen. When organizing regular transportation of children related to the educational process (for example, to school and back), it is necessary to coordinate routes and bus schedules with the traffic police. Transport requirements 1. Bus drivers allowed to transport children must have at least 12 hours of rest between shifts before the trip, and also undergo a briefing. An authorized person of the Contractor enters a note on the driver's special briefing into the bus waybill. The driver carrying out transportation must follow the instructions of the elder, if they do not contradict the Rules for the Transportation of Passengers, the Rules of the Road, and are not related to changing the route of the bus.3. Car transportation of groups of children by bus during the day from 23.00 to 05.00 hours, as well as in conditions of insufficient visibility (fog, snowfall, rain, etc.) is prohibited. During the period of the day from 23.00 to 05.00 hours, as an exception, children are allowed to be transported to and from railway stations and airports, as well as in case of delays on the way to the nearest place of rest (overnight) .4. Transportation of children by bus is carried out only with the dipped headlights on. Transportation of children is prohibited when road or meteorological conditions pose a threat to the safety of transportation.5. The speed of the bus is chosen by the driver depending on the road, meteorological and other conditions, but should not exceed 60 km/h.6. Before the bus departs for a flight, the driver (when driving in a column - the head of the column) must personally verify that the number of departing children and those accompanying the number of seats (for seating) is consistent, that there are no things and equipment in the aisles, on storage areas, that the dipped headlights are turned on. The windows in the passenger compartment of the bus must be closed when driving. The upper shelves may contain light personal items.7. On the way, the bus (buses) can be stopped only at special sites, and in their absence - outside the road, in order to exclude the sudden exit of the child (children) onto the road.8. In the event of a forced stop of the bus caused by a technical malfunction, the driver must stop the bus so as not to interfere with the movement of other vehicles, turn on the emergency signal, and in its absence or malfunction, place an emergency stop sign behind the bus at a distance of at least 15 meters from the bus in the village and 30 meters - outside the village. The eldest gets off the bus first and, located at the front of the bus, directs the disembarkation of children.9. If a child receives an injury along the way, the onset of a sudden illness, bleeding, fainting, etc. the bus driver is obliged to immediately take measures to deliver the child to the nearest medical center (institution, hospital) to provide the child with qualified medical care.10. When transporting children, the bus driver is prohibited from: - driving at a speed of more than 60 km / h; - changing the route; - transporting any cargo, luggage or equipment in the cabin of the bus in which there are children, except for hand luggage and personal belongings of children; - leaving bus or leave your seat if there are children in the bus; - when following in a car column, overtake the bus in front; - get out of the bus if there are children on the bus, including when boarding and disembarking children; - move the bus in the rear move; - to leave his place or leave the vehicle, if he has not taken measures to prevent the spontaneous movement of the vehicle or its use in the absence of the driver.11. When organizing excursions and tourist trips, heads of educational institutions and teachers have to solve the problems of ensuring the safety of students' transportation by various modes of transport. This topic becomes especially topical with the approach of the summer season, when the number of trips of schoolchildren sharply increases during the vacation period. To reliably ensure their safety on the road, a careful approach to the preparation of each trip is necessary. "Methodological recommendations for ensuring sanitary and epidemiological well-being and safety of transportation of organized groups of children by road." can be used in educational institutions for the preparation of documents regulating the duties of teachers and the safe behavior of children during their transportation by road.
1. General requirements
1.1. The organizers of the trip of students in vehicles are obliged to ensure that all participants fulfill the obligations of passengers established by the Rules of the Road of the Russian Federation (sections 4 and 5), as well as the requirements of other regulatory legal acts that determine the organization and security measures for the transportation of people by road.
1.2. Children not younger than seven years old are allowed to group transportation on intercity road transport; children under the age of 7 may be allowed to travel only if they are individually accompanied by employees of an educational institution or parents.
1.3. Students are not allowed to travel by car:
♦ in an agitated state that could lead to security breaches;
♦ under the influence of alcohol, narcotic, psychotropic and toxic substances;
♦ with signs of acute inflammatory (colds and other) diseases;
♦ suffering from illnesses for which such trips are contraindicated.
2. Obligations of the administration of the educational institution
2.1. The administration of the educational institution is obliged to:
♦ to ensure compliance with the requirements of regulatory legal acts for the transportation of children, including the “Methodological recommendations for ensuring the sanitary and epidemiological well-being and safety of transportation of organized groups of children by road”, approved by the head of the Federal Service for Supervision of Consumer Rights Protection and Human Welfare, the chief state sanitary doctor of the Russian Federation G.G. Onishchenko and Chief State Road Safety Inspector of the Russian Federation on September 21, 2006;
♦ determine the route, timing and duration of the trip, the approximate number of its participants;
♦ in cases stipulated by regulatory enactments, apply to a higher organization and obtain permission to transport children by road;
♦ designate the required number of group leaders for the entire duration of the trip, accompanying at least one adult for each vehicle carrying up to 20 children, at least two adults for each vehicle carrying more than 20 children;
♦ formalize decisions on the organization of the trip by order, regulating in it the duties of officials, group leaders, accompanying persons, the route, terms, procedure for preparing and conducting the trip, measures to ensure the safety of students;
♦ organize training for group leaders and accompanying persons – special briefing on safety measures when transporting children by road, study of sanitary and epidemiological rules and methods of first aid for illnesses and injuries;
♦ if possible, take measures to provide group leaders and accompanying persons with mobile phones, establish a procedure for communication with representatives of the administration of the educational institution, deadlines for reporting on the progress of the trip and coordinating unforeseen issues arising during the trip;
♦ to provide group leaders and accompanying telephone numbers for ambulances, rescue services, traffic police and police departments of those areas through which the route will pass, and determine the procedure for contacting them, if necessary, for help to students and to ensure their safety;
♦ ensure that students who wish to travel are selected and that their parents' written consent is obtained;
♦ organize a medical examination of students, identification and exclusion from the number of those sent on a trip for whom it is contraindicated for health reasons;
♦ ensure that students study sections “4. Responsibilities of Pedestrians” and “5. Obligations of Passengers” of the Rules of the Road of the Russian Federation, as well as safety measures and rules of conduct when traveling by motor transport;
♦ when preparing for a trip, draw the attention of students and their parents to the selection of clothing, footwear, and personal hygiene products appropriate for climatic and road conditions;
♦ if the trip lasts more than three hours with the participation of parents, organize the provision of students with unbreakable dishes and food sets (dry rations that are guaranteed to retain nutritional qualities on the way, excluding food poisoning) with the coordination of their assortment with the territorial departments of Rospotrebnadzor in the constituent entities of the Russian Federation, provide for compliance with the drinking regime in accordance with the current sanitary legislation;
