Starting from the new academic year, the gradual introduction of the so-called “effective contract” begins in Moscow schools. From the point of view of the Uchitel trade union, this contract is designed to strictly regulate the duties of teachers and create conditions for reducing wages. The article by Vsevolod Lukhovitsky explains the provisions of Order No. 40 of the Moscow Department of Education and suggests ways to protect the labor rights of teachers.

We publish excerpts from the article. The full text of the article is on the website of the trade union "Teacher".

In writing this text, the author had two tasks. First, compare the norms set out in Order No. 40 with similar norms prescribed in federal regulations. This approach is based on Articles 5 and 6 of the Labor Code of the Russian Federation, according to which “normative legal acts of the executive authorities of the constituent entities of the Russian Federation should not contradict this Code, other federal laws, decrees of the President of the Russian Federation, decrees of the Government of the Russian Federation and regulatory legal acts of federal bodies executive power". Secondly, to offer Moscow teachers ways to protect their labor rights if they are offered to sign an employment contract or an Addendum to an employment contract written in accordance with Order No. 40.

1. Innovations of the Department of Education

The first innovation introduced by Order No. 40 concerns the salary, that is, the base part of the salary. The fact is that the regulations of the federal level clearly state that the base part of the salary should not decrease: “The salary of employees of institutions (excluding bonuses and other incentive payments) when changing the wage system cannot be less than wages (excluding bonuses and other incentive payments) paid to employees before it changes, provided that the volume of labor (official) duties of employees is preserved and they perform work of the same qualifications.

We believe that clause 4.1 of Order No. 40 may lead to a violation of this requirement. The fact is that, the Wage Fund (FOT) \u003d FOTb (basic) + FOTk (compensatory) + FOTst (stimulating). Prior to the entry into force of Order No. 40, the FOTb of teachers (that is, the amount of basic salaries of teachers) all went to pay for teaching hours.

Now the salary includes allowances for checking notebooks and for classroom guidance, which were previously included in the compensatory or stimulating part of the salary.

For educators, this means:
1. An increase in the part of the payroll that is not guaranteed to us. Previously, the incentive or compensatory part of the payroll included both payment for notebooks and payment for class teachers, that is, in fact, it turned out that the teacher could know in advance most of his salary (the base part for hours + checking notebooks + class teachers). Now these payments will be included in the base part, but the percentage of the base (60%) and stimulating (30%) parts does not change.

For example, with a payroll of 100 thousand rubles, the base part is 60 thousand. Prior to the entry into force of Order No. 40, teachers received 60,000 rubles for teaching lessons, 6,000 rubles for checking notebooks, and 10,000 rubles for classroom management. For real incentives, which are determined by certain points and which cannot be calculated in advance, there were 14 thousand rubles left. Now there will be a different calculation: 60,000 base rubles will include the same 10,000 + 6,000, and for the remaining 30,000 teachers will have to compete with each other, not knowing in advance how much they will receive.

2. From the above calculation, it can be seen that the basic part of the payment for teaching work will decrease (unless the total payroll is increased, which cannot be expected in the current economic situation). That is why we consider paragraph 4.1 of Order No. 40 to be contrary to the proposals of the Russian Trilateral Commission.

The second major change concerns the compensatory and incentive part of the payroll. The federal recommendations contain a large and, most importantly, open list. We consider it fundamentally important that in this document compensatory and incentive payments are given in a single list, without distinction. This corresponds to the established long-term practice: for example, additional payments for qualifications and length of service in some Regulations on wages are classified as compensatory, in others - as incentives.

In the text of Order No. 40 of February 12, in paragraphs 6.1 and 7.1, the list was very short and exhaustive, that is, everything that is not provided for in these paragraphs cannot be taken into account.

It turns out that teachers lose several compensatory and incentive payments that have existed so far:
- compensation for methodological literature (it is clear that 100 rubles do not save, but they even want to take them away);
- additional payments for the qualification category, experience, young specialist;
- Surcharge for office management.

It also becomes problematic to receive a compensatory allowance for work with harmful and (or) dangerous and other special working conditions, since now you have to prove every hour of work.

Finally, some of the grounds for incentive payments specified in clause 7.3 (Note 6) do not correspond to the principles of objectivity, predictability and adequacy stated in the federal recommendations, because the rating criteria for educational organizations change annually and it is impossible to predict them in advance.

In addition, it is not clear how incentive payments to a particular employee can depend on the rating of the entire school. And what if the whole school is at the bottom of the rating? Does this mean that all employees should not have incentives? Since 30% for incentives is determined by the same order, the director will have to distribute them exclusively in the form of one-time bonuses, which will further increase the likelihood of bias.

In the original text of Order No. 40, there were several norms that contradicted each other. Order No. 2055 eliminated most of them.

However, it is necessary to pay attention to the very name of the Appendix to Order No. 40 - "Recommendations for the development of wage systems for employees of state educational institutions implementing the main educational programs of primary general, basic general, secondary (complete) general education, subordinate to the Department of Education of the City of Moscow." This name contradicts its content, since already in paragraph 1.1 it is not about recommendations, but about the Regulation, that is, a document of a completely different level. The Moscow Department of Education does not recommend, but orders where it has no right to order, because the establishment of a specific system of remuneration by labor legislation is not within the competence of the regional authorities, but of the employer (Article 135 of the Labor Code of the Russian Federation). It is the director of the school, together with the employees, who must decide how to distribute the payroll.

2. Recommendations for teachers

Order No. 40 does not say anything about the so-called "effective contract", which sooner or later will be asked to sign each teacher. It was planned to transfer all teachers to an “effective contract” from September 1, 2015, now they are talking about extending the preparation for the transition until January 1, 2016.

Imagine that the text of this contract (or the Addendum to the employment contract) will be based on Order No. 40. What does this mean for teachers?

Let's briefly summarize:
-reduced teaching hourly pay
- the “weight” of incentive payments will increase in the salary (that is, additional payments that are not guaranteed to the employee in advance)
- there will be no payment for office management and methodological literature
- there will be no additional payments for qualifications and work experience
-reduced surcharges for work with harmful substances
- the number of paid educational services will increase
- the salary of each teacher will directly depend on the place in the ranking.

How should employees behave in this case?

First, insist on the strictest possible observance of the procedure. Before signing such an agreement, all local acts must be changed, because the current ones are based on old federal and regional documents. To make, for example, changes to the collective agreement, it will take more than one month, especially if the employer is the initiator of the changes. In negotiations with the employer, the main argument will be the principle of labor law, which has already been discussed: in local acts, the guarantees to employees contained in the Labor Code and other regulations cannot be reduced, but can be increased. If, for example, teachers decide that among the compensatory surcharges there should be surcharges for a young specialist, then no inspection inspections will be able to challenge this norm included in the collective agreement.

Secondly, one can insist on the most exact observance of all the requirements for an “effective contract”. For example, let the employer put down all the specific numbers in the contract: the basic payment of the hourly rate, all types of compensation and incentives. Since the contract (Supplemental Agreement) is signed at the beginning of the school year, and funding may change from the beginning of the new fiscal year, employees can take advantage of the situation and secure a guaranteed salary. It will be especially interesting to see how the directors solve the problem of designation in the Additional Agreement of incentive payments in accordance with Order No. 40. After all, specific figures and indicators should be indicated. In no case should you agree to the wording “based on performance”, “in accordance with the Regulation on incentive payments” - in extreme cases, it is possible to indicate as a percentage of the salary (for example, “stimulating payments in the form of a one-time bonus once a quarter in the amount of 50% from salary").

Thirdly, remember that the employee has the right to disagree with any clause of the "effective contract". The employer does not have the right to dismiss a teacher who has entered into an agreement for an indefinite period, just because he does not agree with some clauses of the Supplementary Agreement. Please note: the order of any superior is not a legitimate reason for changing the terms of the contract!

Thus, we can safely say that to dismiss a teacher using Art. 74 is very difficult.
How the “effective contract” is imagined by the Ministry of Labor and the Ministry of Education will have to be written in a separate article.
